Florida Judge Ignores Evidence, Rules Barack Obama Natural Born Citizen
Florida Circuit Judge Terry Lewis shocked Florida conservatives by ruling that Barack Obama was a natural born citizen
since he was born in the United States. Lewis also ruled that the
Florida Secretary of State is not responsible to determine the
eligibility of political candidates. Additionally, Lewis dismissed the
lawsuit ‘with prejudice’
citing that Obama’s attorneys were correct to say that he was not yet
the party’s official candidate and therefore his eligibility could not
be challenged.
Evidently, Judge Lewis ignored the sworn affidavits submitted by Maricopa County Sheriff Joe Arpaio and Cold Case Posse lead investigator Mike Zullo, claiming that birth certificate, Social Security Card and Selective Service Registration Card were all fraudulent and that they is no evidence to prove that Obama was born in the United States.
In his dismissal of the case, Judge Lewis said:
“The United States Supreme Court has concluded that ‘every person born in the United States, and subject to the jurisdiction thereof, becomes at once a citizen of the United States.’”
“Other courts that have considered the issue in the context of challenges to the qualifications of candidates for the office of president of the United States have come to the same conclusion.”
Attorney for Michael Voeltz who filed the suit to have Obama declared ineligible commented on Judge Lewis’ ruling:
“The decision issued today by Judge Terry Lewis was poorly reasoned
and written. It goes against prior Florida Supreme Court precedent in
particular, thus making our chances on appeal great. … In any event,
Plaintiff Michael Voeltz filed a new complaint today for declaratory
relief, which will, in addition to his appeal, now proceed forward. In
short, we remain confident that if the Florida courts ultimately decide
to obey their own election law, we will prevail in the end.”
“He basically said that a presidential candidate can never be nominated under Florida law, ever, and that’s just wrong. He made our appeal relatively easy, because he flies in the face of the Florida statute and also a Florida Supreme Court case. There’s nothing on which for him to come to this conclusion. The law is clear here that Obama was nominated for office.”
“The judge equated being a ‘citizen’ with a ‘natural born citizen’ and cited no authority to conclude the two terms are the same. He quotes other state’s cases, where judges reached that conclusion, but that’s not precedent for him. What other courts said in lower cases means nothing to him.”
Judge Lewis’ ruling is a blow to those who believe that Barack Obama is not eligible to hold the office of President of the United States because he is not a natural born citizen and the fact that there is still no concrete evidence that he was born in the United States. I’m sure that cases pending in other courts will turn to this ruling in making their decisions.
However, if Klayman is correct in the appeal and the new case being filed, there still may be hope of getting a favorable ruling. We will have to watch to see what happens. In the meantime, I hope everyone continues to focus on Obama’s largest tax increase in U.S. history and how he continues to lie about it and about never raising taxes on middle income Americans.
